Old customers are now suffering from the fight against the rights of the public
An infringement lawsuit reflects Shenzhen's LED industry technology shortcomings, and relevant departments have issued a series of support measures.

Rights struggle
"There is no business ethics!" Wu Min, general manager of Jinliyuan, was resentful when he talked about the dispute with Cost.
According to Wu Min, Jin Liyuan and Cosette have had business contacts since 2006. In 2007, Kesite began to purchase Jinliyuan's products in large quantities, which is the company's more loyal customers. At that time, Jin Liyuan was mainly responsible for the R&D and production of high-power LED lighting application products and supply to domestic foreign trade companies, while Kesite purchased products from Jinliyuan to promote sales in foreign markets. The two parties have been working together happily.
However, since March 2008, Jin Liyuan suddenly did not have a Coster order, which made Wu Min feel a bit strange, and soon he found that the other party was copying his own patented products.
Wu Min said that the other party initially promised not to copy their own products. But in 2009, Jin Liyuan found that the other party copied his own products again. In April 2009, Jin Liyuan began to ask lawyers to defend his rights. The court filed the case in October of that year, but for various reasons, it was not until May 20 this year that the case was first heard.
Jin Liyuan believes that the other party's infringement has not only caused vicious competition, but also seriously affected the reputation of its products. In order to make up for the loss and also to warn the other party, Jin Liyuan decided to claim 700,000 yuan from the other party.
In this regard, the chairman of the company, Wang Jinlin, said that his company has developed rapidly in recent years, and the other party still stays on the previous basis, and wants to be famous for the so-called patent. Regarding the allegations of Jin Liyuan, Coster believes that the so-called patent rights of the other party are actually not technical in nature, and there is no patent, and there is no infringement.
At present, due to the question of the patent right of Jin Liyuan by Keite, it is necessary to wait for the patent examination committee of the State Intellectual Property Office to review the patent right of Jin Liyuan before the court can determine whether it is infringing.
In response to the statement of Coster, the reporter specifically consulted relevant professionals. Deputy Director of the Shenzhen Municipal Market Supervision Administration Cheng Shujun said that the appearance patent itself does not talk about the technical content, but it can initiate the invalidation procedure to the State Intellectual Property Office and revoke the patent.
Industry pain
Although Jin Liyuan and Coster are not large in scale, they are not very famous in the industry. However, the disputes between the two companies reflect a problem existing in the LED industry in Shenzhen and even the country--the lack of competitive core technologies, and infringements occur from time to time.
LEDs are a compound semiconductor component that converts electrical energy into light. LED has the advantages of high luminous efficiency, environmental protection, long life and small size. Driven by the low-carbon economy policy of energy conservation and emission reduction, the LED industry cake is rapidly becoming bigger. Yan Shirong, vice president of Shenzhen LED Industry Association, said that the total value of LED industry in China will exceed 100 billion this year. As the leader of LED industry development in China, the output value of last year has reached 24.5 billion yuan, accounting for one-third of the country's total. It is estimated that this year is expected to reach 40 billion yuan. According to the plan of the Shenzhen Municipal Government, the total value of the LED industry in Shenzhen is expected to reach 130 billion to 150 billion yuan in 2015.
Qi Shirong also admitted that although the Shenzhen LED industry has developed rapidly, the short board has gradually become prominent. He pointed out that in general, Shenzhen is still in the low-end application of the industrial chain. Although there are more than a thousand LED-related companies, many of them are just some very small manufacturers, lacking core technology and competitiveness.
Urgent to be regulated
In response to the current problems in the LED industry in Shenzhen, Xiong Jianming, a member of the Shenzhen Municipal People's Political Consultative Conference and Chairman of Fangda Group Co., Ltd., repeatedly called on the government to vigorously support and standardize the LED industry in the city.
Yan Shirong told reporters that the Shenzhen Municipal Government has now increased the regulation and support for the LED industry and will provide a series of policy support for the LED industry.
At present, relevant departments have begun to build eight major platforms, including Huaqiang North LED Purchasing Center, LED Technology R&D Institute, and Observation Research Center. Among them, LED technology research and development institute settled in Nanshan District, will apply for the construction of national-level LED R & D center; will also build Shenzhen International LED Viewing Research Center, Guanjing Industrial Design Park; set up LED standard alliance and patent alliance in Shenzhen; build in Guangming New District LED industrial zone; build a unique service platform in the financial services field.
Ruan Shirong said that if this series of policies is implemented as soon as possible, Shenzhen's LED industry will be well regulated, and it is expected to build ZTE and Huawei within the LED industry within 10 years.
Shenzhen Kesite Optoelectronics Co., Ltd. was originally an old customer of Jinliyuan Optoelectronics Technology Co., Ltd., but recently, Jin Liyuan sued Coster in court and sued the latter for infringing on its five appearances and one utility model patent.
Although the lawsuit has not yet been closed, the dispute between the two companies reflects the shortcomings of the LED industry in Shenzhen and even the whole country: most of the enterprises are small in scale and lack competitive core technologies.
